Please read these Terms of Service ("Terms") carefully before using the Claris Diamond website (the "Site") or purchasing any products from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Claris Diamond ("we," "us," "our") is an Australian jewellery care brand founded on Sydney's Northern Beaches. We design and sell jewellery cleaning tools, including our signature cleaning pen and gifting sets, intended for everyday, on-the-go care of fine and fashion jewellery.

Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell our products and services to you.

2. Eligibility

You must be at least 18 years old, or using the Site under the supervision of a parent or guardian, to place an order with us. By using the Site, you confirm the information you provide us is accurate and that you have the legal capacity to enter into a binding contract.

3. Products

We make every effort to display our products, including colours, finishes, and packaging, as accurately as possible. However:

  • Slight variations may occur between images shown on screen and the product received, due to photography, lighting, and individual device displays.
  • Products are described as accurately as possible, but we do not warrant that descriptions or other content on the Site are entirely error-free.
  • Claris Diamond products are designed for the cleaning and care of jewellery. They are not designed, tested, or intended for any other use. Please refer to the instructions and cautions included with your product before use.
  • We may update product formulations, packaging, or set contents from time to time. Any substituted product supplied for an accepted order will not be materially different from the product described at checkout without your agreement, except where permitted by law.

4. Orders and Pricing

  • All prices are listed in Australian Dollars (AUD) and are inclusive of GST.
  • We reserve the right to change prices at any time without notice. The price charged will be the price displayed at the time you complete your order.
  • By placing an order, you are making an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, pricing errors, or stock unavailability. If we decline your order after payment has been taken, we will provide a full refund.
  • You will receive an order confirmation email once your order has been placed. This confirms we have received your order — it does not guarantee acceptance.

Errors, inaccuracies and omissions Occasionally the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any such errors and to change, update, or cancel orders — including after an order has been submitted — if information related to that order is found to be inaccurate, without prior notice. We are under no obligation to update or clarify information on the Site except where required by law.

Order and quantity limits We reserve the right to limit or cancel quantities purchased per person, household, or order. This may include orders placed under the same customer account, payment method, or shipping/billing address, where we reasonably suspect bulk purchasing for resale or other misuse. Where we cancel or amend an order for this reason, we will attempt to notify you using the contact details provided at checkout.

If we cancel an order after payment has been processed, we will refund the amount paid for the cancelled items, including any applicable shipping charges, to the original payment method.

5. Payment

We accept payment via the methods displayed at checkout. By providing payment details, you confirm that you are authorised to use the payment method and that the information provided is true and accurate. All payments are processed securely through our third-party payment providers; we do not store full payment card details on our servers.

6. Shipping and Delivery

  • We currently ship within Australia only.
  • Estimated delivery timeframes are provided at checkout and on our shipping policy page but are not guaranteed. Delivery times may be affected by circumstances outside our control, including courier delays, public holidays, and high-demand periods.
  • It is your responsibility to ensure your shipping address and contact details are correct at the time of order. We are not liable for orders delayed or lost due to incorrect address details provided by you.
  • Shipping costs, if any, will be clearly displayed at checkout prior to payment.

Delivery risk

Risk in the goods, including risk of loss or damage, passes to you once the order has been delivered to the address provided at checkout. This clause governs risk in the goods only — it does not limit or affect any right you have under the Australian Consumer Law, and does not prevent you from raising a claim with us, or with the courier, if a parcel is lost, damaged in transit, or not received despite being marked as delivered.

Parcel marked as "delivered" but not received

If courier tracking shows your order as delivered but you have not received it, please:

  1. Check with household members, neighbours, or your building's parcel collection point — couriers will sometimes leave parcels in a safe place or with a neighbour;
  2. Allow up to 14 business days, as tracking can occasionally update slightly ahead of physical delivery;
  3. Contact us at hello@clarisdiamond.com with your order number if the parcel still cannot be located.

We will investigate with the courier on your behalf. Depending on the outcome, we will offer a replacement, refund, or other appropriate resolution. This process is in addition to, and does not limit, your rights under the Australian Consumer Law.

7. Returns, Refunds and Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any rights you have under the Australian Consumer Law (ACL) or any other applicable consumer protection legislation. Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Change of mind We do not accept returns of products that have been opened or used unless the customer is entitled to a remedy under the Australian Consumer Law. We accept change-of-mind returns of unopened and unused products in their original packaging within [14/30] days of delivery. Customers are responsible for return shipping, and original shipping charges are not refundable, except where required by law.

Faulty or damaged items If your order arrives faulty, damaged, or not as described, please contact us as soon as reasonably possible at hello@clarisdiamond.com with your order number and, where available, photographs of the issue. Any timeframe stated in our voluntary returns policy does not limit your rights under the Australian Consumer Law.

How to initiate a return Contact hello@clarisdiamond.com with your order number before returning any item. Items returned without prior contact may not be accepted. Return shipping costs are the responsibility of the customer unless the item is faulty or the return is a result of our error.

8. Gift Sets and Promotions

The Cleaning Pen Duo and any other bundled products are sold as a set. Individual components are not sold separately unless explicitly offered on the Site. Promotional pricing, discount codes, and gifts-with-purchase are subject to individual terms displayed at the time of the offer and may be withdrawn or amended at our discretion.

Promotional terms operate in addition to, and do not limit or replace, any right you have under the Australian Consumer Law.

9. Intellectual Property

All content on the Site — including the Claris Diamond name, logo, marque, product photography, packaging design, and written content — is owned by or licensed to Claris Diamond and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, or use any content from the Site for commercial purposes without our prior written consent.

10. User Conduct and Prohibited Uses

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose, or to solicit others to perform or participate in any unlawful acts;
  • Violate any international, federal, state, territory, or local law, regulation, or ordinance;
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others;
  • Harass, abuse, insult, harm, defame, intimidate, or discriminate against anyone on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • Submit false, misleading, or fraudulent information, including when placing an order;
  • Upload or transmit viruses, worms, or any other code of a malicious or destructive nature;
  • Collect or track the personal information of other users;
  • Spam, phish, pharm, pretext, spider, crawl, or scrape the Site or its content;
  • Attempt to gain unauthorised access to the Site, our systems, or related networks, or otherwise interfere with or circumvent the security features of the Site;
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or Service without our express written permission.

A breach of any of these Terms may result in immediate termination of your access to the Service, at our sole discretion (see Section 17, Termination).

11. User Comments and Submissions

If you submit a review or other content intended for publication, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce, edit, publish, and use that content for operating and promoting Claris Diamond, subject to our Privacy Policy and applicable law.

12. Jewellery and Product Use Disclaimer

By purchasing and using our products, you acknowledge and agree that:

Our products must be used only in accordance with the supplied instructions, warnings, and compatibility guidance. Results may vary according to a jewellery item’s materials, coatings, treatments, settings, age, and condition.

Before use, check the product instructions to confirm that the cleaning product is suitable for your jewellery. Do not use it on any material identified as unsuitable in those instructions. If you are uncertain—particularly with pearls, opals, porous or soft gemstones, antique jewellery, plated finishes, treated stones, or delicate settings—consult a qualified jeweller before use.

To the extent permitted by law, Claris Diamond is not responsible for damage caused by misuse, use contrary to the supplied instructions, or use on materials identified as unsuitable. Nothing in this section excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Nothing in this section limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded (see Section 7).

13. Limitation of Liability

Consumer guarantee claims Our products are of a kind ordinarily acquired for personal, domestic, or household use. Under the Australian Consumer Law, we are not entitled to limit our liability for a failure to comply with a consumer guarantee in respect of goods of this kind, and we do not attempt to do so. Where a product fails to meet a consumer guarantee under Section 7 of these Terms, you are entitled to the remedies set out in the Australian Consumer Law, which may include repair, replacement, refund, and, in the case of a major failure or where the failure results from a defect we could reasonably have been expected to know about, compensation for any reasonably foreseeable loss or damage — which may include damage caused to jewellery, diamonds, or gemstones by a defective product.

Other claims For any liability that does not arise from a failure to comply with a consumer guarantee (for example, claims relating to your general use of the Site, delays, or matters outside the scope of the ACL guarantees), our liability is limited, to the maximum extent permitted by law, to the replacement or repair of the relevant product, or a refund of the amount paid for it.

We do not guarantee that your use of the Site or Service will be uninterrupted, timely, secure, or error-free, and the Site and all products are provided "as is" and "as available" without warranties or conditions of any kind, except as required by law or set out in these Terms.

We are not liable for any indirect, incidental, punitive, special, or consequential loss arising from the use or misuse of our products or the Site outside the scope of the consumer guarantees described above, including loss or damage arising from use of a product other than in accordance with the instructions provided. Nothing in this section excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

14. Indemnification

To the extent permitted by law, you are responsible for loss suffered by us as a direct result of your unlawful use of the Site, wilful misconduct, or material breach of these Terms. You are not responsible to the extent that the loss was caused or contributed to by our acts, omissions, negligence, or breach of law.

15. Privacy

Your use of the Site is also governed by our Privacy Policy, available at clarisdiamond.com/pages/privacy-policy, which explains how we collect, use, and protect your personal information in accordance with the Australian Privacy Principles.

16. Third-Party Links and Tools

The Site may contain links to third-party websites or services, including social media platforms, and may make use of third-party tools over which we have no control. We are not responsible for the content, accuracy, or practices of any third-party site or tool, and inclusion of a link does not imply endorsement. Any use of third-party tools or websites linked from the Site is entirely at your own risk, and you should review the relevant third party's own terms and privacy practices before engaging with them.

17. Termination

These Terms remain effective unless and until terminated by either you or us. You may stop using the Site at any time, which will be treated as termination on your part.

If we determine, in our sole judgement, that you have failed to comply with any part of these Terms, we may suspend or terminate your access to the Site or Service at any time and without notice. Any obligations or liabilities incurred by either party prior to termination will survive that termination.

18. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with any policies referenced within them (including our Privacy Policy and any Shipping or Returns policy), constitute the entire agreement between you and Claris Diamond regarding your use of the Site, and supersede any prior agreements or understandings, whether oral or written. Our failure to enforce any right or provision of these Terms will not be treated as a waiver of that right or provision.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal or operational reasons. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

21. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Site are subject to the non-exclusive jurisdiction of the courts of New South Wales. This clause does not remove any right you may have under law to bring proceedings in another jurisdiction.
